The U.S. International Trade Commission (ITC) announced that it would uphold existing countervailing duty orders on hot-rolled steel products from India, Indonesia, and Thailand and existing antidumping duty orders on these products from China, India, Indonesia, Taiwan, Thailand, and the Ukraine.

The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the ITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) or of material injury (ITC) within a reasonably foreseeable time.

The ITC will, however, revoke existing countervailing duty orders on hot-rolled steel products from Argentina and South Africa, as well as existing antidumping duty orders on these products from Argentina, Kazakhstan, Romania, and South Africa.
The decision to uphold existing order on imports from China, India, Indonesia, Taiwan, Thailand, and Ukraine follows the recent affirmative finding by the Department of Commerce, as well as the ITC’s subsequent determination that revoking these orders would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.
The ITC had determined that revoking the existing orders for imports from Argentina, Kazakhstan, Romania, and South Africa would not be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time, hence these orders will be revoked.
All six Commissioners made affirmative determinations with respect to China, India, Indonesia, Taiwan, Thailand, and Ukraine. With respect to Kazakhstan, Romania, and South Africa, Chairman Daniel R. Pearson, Vice Chairman Shara L. Aranoff, and Commissioners Deanna Tanner Okun and Irving A. Williamson made negative determinations; Commissioners Charlotte R. Lane and Dean A. Pinkert made affirmative determinations. With respect to Argentina, Chairman Pearson, Vice Chairman Aranoff, and Commissioners Okun, Williamson, and Pinkert made negative determinations; Commissioner Lane made an affirmative determination.
This action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act.
